Terms of Use

Welcome to NowSpinning, a mobile application provided by Michael Place (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your use of the NowSpinning app and related services (the “App”).

By using NowSpinning, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

NowSpinning is intended for users aged 13 and older. By using the App, you confirm that you meet this age requirement. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

2. Description of Service

NowSpinning is a companion app for vinyl record collectors. It allows you to browse your Discogs collection, log what you're playing, view listening statistics, and connect with other collectors through community features.

3. User Accounts

• You must create an account via phone number authentication to use the App.
• You may link your Discogs account to sync your vinyl collection.
• You are responsible for safeguarding your account credentials.
• We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Discogs Integration

• NowSpinning accesses your Discogs collection and wantlist via the Discogs API using OAuth authorization you provide.
• We do not modify your Discogs data. All collection changes are read-only syncs.
• Your Discogs credentials are stored securely and used solely to provide app functionality.

5. Premium Subscription

NowSpinning offers optional premium features available through auto-renewable subscriptions and a one-time lifetime purchase (“Premium”).

• Monthly subscription: Billed monthly after a 7-day free trial. The trial converts to a paid subscription unless canceled at least 24 hours before the trial ends.
• Annual subscription: Billed annually. Automatically renews unless canceled at least 24 hours before the end of the current period.
• Lifetime purchase: A one-time purchase granting permanent access to Premium features.
• Payment is charged to your Apple ID account at confirmation of purchase.
• You can manage or cancel subscriptions at any time through your device's Settings > Apple ID > Subscriptions.
• Refund requests must be directed to Apple through their standard process.
• Premium features include the audio visualizer, Philips Hue ambient lighting, always-on music recognition, vinyl wall collection view, and other features as described in the App.
• We reserve the right to change subscription pricing. Existing subscribers will be notified before any price change takes effect.

6. User Content

• You may upload photos and other content (vinyl shots, setup photos, comments) to the App.
• You retain full ownership of your content. By uploading, you grant us a non-exclusive, royalty-free license to store and display the content as necessary to provide the App's features.
• Content you share in community features (comments, ratings, setup shots) is visible to other users.
• You agree not to upload content that is unlawful, offensive, or infringes on third-party rights.

7. Community Guidelines

When using community features (comments, ratings, direct messages, community spins), you agree to:

• Treat other users with respect
• Not post spam, harassment, or abusive content
• Not impersonate other users
• Not use the platform for commercial solicitation

We reserve the right to remove content and suspend accounts that violate these guidelines.

8. Direct Messages

• NowSpinning provides a direct messaging feature for private communication between users.
• You are solely responsible for the content of messages you send.
• We do not actively monitor private messages, but may review them if reported for violations.
• You may block other users at any time to prevent them from contacting you.

9. Audio Recognition

• NowSpinning uses ShazamKit to identify music playing near your device.
• Audio recognition is initiated only by you and processes audio on-device.
• Audio samples are not stored or transmitted to our servers.

10. Privacy and Data

Your data is governed by our Privacy Policy. We do not sell personal information or use it for targeted advertising. We do not track users across apps or websites owned by other companies.

11. Intellectual Property

• The NowSpinning app, design, features, and branding are the property of Michael Place or its licensors.
• Discogs data, album artwork, and related metadata are the property of their respective owners and are displayed under the terms of the Discogs API.
• You may not use our intellectual property without written permission.

12. Third-Party Services

NowSpinning integrates with third-party services including Discogs, Firebase, ShazamKit, Apple Music, Last.fm, and Philips Hue. Your use of these services is subject to their respective terms and policies.

13. Disclaimer of Warranties

• The App is provided “as is” and “as available.”
• We do not guarantee that the App will be free from errors or interruptions.
• We are not responsible for the accuracy of data synced from Discogs or other third-party sources.

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. We are not liable for loss of data or unauthorized access to your account due to your actions or negligence.

15. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the App. Continued use of the App constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
